  7. LICENSE AGREEMENT
  8. =============================================================
  9. ATTENTION: This License Agreement is a legal agreement between you
  10. (either an individual or a single entity) and Two Pilots, Inc.
  11. It defines what you may do with the product and contains limitations
  12. on warranties and/or remedies. This license is granted by Two
  13. Pilots for all products purchased either directly or though any
  14. authorized agent of the company.

  16. IMPORTANT:  CAREFULLY READ THIS LICENSE BEFORE USING THIS PRODUCT.
  17. INSTALLING, COPYING, OR OTHERWISE USING THIS PRODUCT INDICATES YOUR
  18. ACKNOWLEDGMENT THAT YOU HAVE READ THIS LICENSE AND AGREE TO ITS TERMS.  
  19. IF YOU DO NOT AGREE, RETURN THE COMPLETE PRODUCT TO TWO PILOTS 
  20. FOR A FULL REFUND.  THIS LICENSE AGREEMENT IS YOUR PROOF OF LICENSE.  
  21. PLEASE TREAT IT AS VALUABLE PROPERTY.

  23. A.  TWO PILOTS WILL:
  24.  
  25. Provide you with a computer program (hereafter called the "Program"),
  26. which may also have "online" or electronic documentation, this license
  27. agreement (hereafter called the "License"), and other printed materials
  28. (together called the "Product").  Two Pilots grants you a license
  29. to use the Product in accordance with the terms of this agreement. The
  30. copyright and all other rights to the Product will remain with us 
  31. and/or our suppliers.

  33. B.  YOU MAY:  
  34.  
  35. 1. Install and use one copy of the Product only on a single computer.
  36. This copy is to be used exclusively by a single user at a time. You
  37. will need to purchase a new license for each additional computer or
  38. user. If you want to install and use the copy in the network (on 
  39. computer file server) you need to purchase an additional license for
  40. all computers with access to this Product.
  41. 2. Make one copy of the Product for archive or backup purposes. 
  42. 3. Install one copy of the Product on your portable computer but for
  43. your individual use only.
  44. 4. Transfer the Product to someone else, only if you assign all of
  45. your rights under this License, cease all use of the Product, erase
  46. or destroy any copy(ies) (including the hard disk copy) made in 
  47. support of your use of the Product, and ensure that the other person
  48. agrees to the terms of this License.

  52. C.  YOU MAY NOT:

  54. 1. Use the Product or make copies of it except as permitted in this
  55. License. 
  56. 2. Translate, reverse engineer, recompile, or disassemble the Product
  57. except to the extent the foregoing restriction is expressly prohibited
  58. by applicable law.
  59. 3. Rent, lease, assign, or transfer the Product except as set out in
  60. paragraph B above.
  61. 4. Modify the Product or merge all or any part of the Product with
  62. another program.
  63. 5. Use the previous versions of the Product. After the update all
  64. copies of the previous versions must be destroyed.

  66. D.  TERM:  
  67.  
  68. This License will continue as long as you use the Product.  However,
  69. it will terminate if you fail to comply with any of its terms or
  70. conditions. You must agree, upon termination, to destroy all copies
  71. of the Product.  The Limitations of Warranties and Liability set out
  72. below will continue in force even after any termination.

  74. E.  WARRANTY:

  76. We warrant that the Product will perform substantially in accordance
  77. with the accompanying materials for a period of ninety days from the
  78. date you acquire it. If such a defect occurs, it will be replaced free
  79. of charge. This remedy is your exclusive remedy for breach of this
  80. warranty. It gives you certain rights and you may have other legislated
  81. rights, which may vary from jurisdiction to jurisdiction.

  83. F.  LIMITATION OF WARRANTIES AND LIABILITY:

  85. Except for the express warranty above, the product is provided on an
  86. "as is" basis, without any other warranties or conditions, expressed
  87. or implied, including, but not limited to, warranties of merchantable
  88. quality, merchantability or fitness for a particular purpose, or those
  89. arising by law, statute, usage of trade, or course of dealing. The 
  90. entire risk as to the results and performance of the product is 
  91. assumed by you. Neither we nor our dealers or suppliers will have any 
  92. liability to you or any other person or entity for any indirect, 
  93. incidental, special, or consequential damages whatsoever, including, 
  94. but not limited to, loss of revenue or profit, lost or damaged data or
  95. other commercial or economic loss, even if we have been advised of the
  96. possibility of such damages, or they are foreseeable. We are also not
  97. responsible for claims by any third party. Our maximum aggregate 
  98. liability to you and that of our dealers and suppliers will not exceed
  99. the amount paid by you for the product.

  101. G.  GENERAL:

  103. This License is the entire agreement between us, superseding any other
  104. agreement or discussions, oral or written, and may not be changed 
  105. except by a signed agreement.
